Terms of Service

1. Acceptance
By using TLCDesk you agree to these terms. If you don't agree, don't use the service.
2. Eligibility
- Drivers must hold a valid NYC TLC FHV license.
- Drivers must be 21 or older (NYC TLC commercial hack license requirement).
- Vehicle owners must hold valid NY vehicle registration and TLC base authorization for the vehicle.
- All users must pass identity verification.
3. Service Description
TLCDesk is a marketplace connecting NYC TLC-licensed drivers with vehicle owners for weekly vehicle rentals. TLCDesk is not a party to rental agreements — we facilitate discovery, payment processing, and communication between drivers and owners.
4. Fees
- Platform fee: up to 15% of weekly rental payments, deducted from owner payouts. Current fee: 8%.
- Payment processing fees (by Stripe): passed through.
- TLCDesk may change fee structure with 30 days notice to owners.
5. Driver Obligations
- Maintain valid TLC license throughout the rental.
- Maintain valid DMV Class E license.
- Pay weekly rent on time.
- Not sub-rent the vehicle.
- Return the vehicle in the same condition as pickup.
- Pay for damages, tickets, and violations incurred during the rental.
6. Owner Obligations
- Maintain valid TLC vehicle authorization.
- Maintain valid commercial auto insurance.
- Provide accurate vehicle listings.
- Complete pickup handover within 48 hours of approval.
- Refund deposit within 7 days of rental termination, minus documented deductions.
7. Payments
- First week + deposit charged at checkout authorization.
- Weekly recurring charges every Monday via Stripe Subscriptions.
- Payment failures trigger a 24-hour grace period before auto-termination.
- All charges in USD.
8. Deposits
- Deposit = one week's rental rate.
- Held for duration of rental + 7 days post-termination.
- Deductions documented by owner with photo evidence.
- Driver may dispute deductions within 7 days.
- Net deposit refunded to the original payment method.
9. Violations & Damages
- Driver responsible for: parking tickets, toll violations, damages, excessive cleaning needs, unusual fuel usage.
- NYC camera violations (red light, speed, bus lane, school zone) and TLC vehicle summons remain owner responsibility under NY law — not deductible from driver deposit.
- Serious violations (DUI, reckless endangerment) may result in immediate termination and account suspension.
10. Termination
- Driver may terminate after minimum commitment period with 7 days notice.
- Owner may terminate at any time with 7 days notice.
- TLCDesk may terminate any account for violations of these terms.
- Termination does not waive accrued obligations.
11. Dispute Resolution
Disputes between driver and owner should be addressed first through in-app messaging. TLCDesk provides dispute mediation for deposit deductions. Unresolved disputes are subject to binding arbitration in New York County, New York.
12. Limitation of Liability
TLCDesk is not liable for:
- Vehicle mechanical failures.
- Traffic accidents.
- Criminal acts by drivers or owners.
- Tax obligations (owners responsible for reporting rental income; drivers responsible for any 1099 reporting).
- Loss of income due to vehicle unavailability.
Maximum TLCDesk liability: fees paid in the prior 30 days.
13. Privacy

14. Changes
We may update these terms with 30 days notice. Continued use constitutes acceptance.
15. Governing Law
New York State law governs. Venue: New York County.
